By using TimeTracker.Best ("the service"), you agree to these Terms of Service. If you do not agree, do not use the service.
BETA NOTICE — ACKNOWLEDGMENT OF RISK
TimeTracker.Best is currently in a BETA / pre-release phase. By creating an account or using the service you acknowledge and agree that the service is provided on a pre-release basis and may contain bugs, errors, defects, or downtime. You accept the risk that time entries and other data you enter could be lost, duplicated, delayed, or made temporarily unavailable.
The good news: your data is stored on Google Cloud Firestore with automatic multi-zone replication and point-in-time recovery, and we will make commercially reasonable efforts to restore affected data from backups in the event of any incident. You are still encouraged to use the app's CSV / PDF export features for your own records of anything you consider critical. Full disclaimer of risk and liability is set out in Section 12 below.
1. The service
TimeTracker.Best provides time-tracking software for macOS and the web. The service is provided "as is" without warranty of any kind. We may modify, suspend, or discontinue features at any time.
2. Your account
You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. You must be at least 13 years old (16 in the EEA) to create an account. You agree to provide accurate information and to keep it up to date.
3. Acceptable use
You agree not to:
- Use the service for any unlawful purpose.
- Attempt to reverse-engineer, decompile, or bypass any security mechanism of the service.
- Upload content that infringes another party's rights or violates applicable law.
- Interfere with, overload, or disrupt the service or its infrastructure.
4. Your content
You retain ownership of the time entries, project descriptions, client names, and other content you enter. You grant us a limited license to store, process, and display that content solely to operate the service for you. We will not use your content to train AI models, sell it, or share it with third parties outside the processors listed in our Privacy Policy.
5. Pricing
Version 1.0 of the TimeTracker Best Mac app is free. Future versions may introduce paid plans or subscriptions. If we introduce paid plans, we will give you advance notice and honor any published terms relating to your existing account. Pricing, free trials, and renewal terms will be clearly disclosed before you are charged.
6. Termination
You may delete your account at any time. We may suspend or terminate your account if you materially breach these terms or engage in fraudulent, abusive, or illegal activity. Upon termination, your data will be deleted as described in the Privacy Policy.
7. Disclaimer of warranties
The service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or secure.
8. Limitation of liability
To the maximum extent permitted by law, TimeTracker.Best and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data, arising out of or in connection with your use of the service. Our total aggregate liability for any claim shall not exceed the greater of (a) amounts you paid us in the twelve months preceding the claim, or (b) fifty U.S. dollars ($50).
9. Indemnification
You agree to defend, indemnify, and hold harmless TimeTracker.Best and its operators from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the service, your content, or your violation of these terms.
10. Changes to these terms
We may update these terms from time to time. Material changes will be posted here with an updated "Last updated" date and, where appropriate, notified in the app. Your continued use of the service after changes become effective constitutes acceptance of the updated terms.
11. Governing law
These terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules. Any dispute arising from or relating to these terms or the service shall be resolved exclusively in the state or federal courts located in California.
12. Beta service — acknowledgment of risk (IMPORTANT)
TimeTracker.Best is currently offered on a BETA / pre-release basis. By creating an account, signing in, or otherwise using the service during this phase, you acknowledge and agree to each of the following:
(a) Pre-release, "AS IS." The service is provided on a pre-release, "as is," "as available," and "with all faults" basis for the duration of the beta period. The service may contain bugs, errors, defects, missing features, or security vulnerabilities, and may be unstable, incomplete, or interrupted without notice.
(b) Data-loss risk. You acknowledge that data loss, inaccurate synchronization, corrupted entries, failed backups, and unexpected downtime are possible. You accept the risk that any or all of the time-tracking data you enter could be lost, duplicated, delayed, or made temporarily unavailable. You are solely responsible for maintaining your own records and backups of any data you consider important, including by using the app's CSV and PDF export features.
(c) Release and waiver. To the fullest extent permitted by applicable law, you hereby waive, release, and hold harmless TimeTracker.Best, its operators, officers, agents, contractors, and affiliates (collectively, the "Released Parties") from any and all claims, demands, damages, losses, costs, and liabilities — whether direct, indirect, incidental, consequential, special, exemplary, or punitive — arising out of, related to, or in connection with your use of the beta service, including without limitation loss of data, loss of business, lost profits, loss of revenue, loss of goodwill, cost of substitute services, or any other commercial, personal, or reputational damages, even if the Released Parties have been advised of the possibility of such damages.
(d) California carve-out (required). Nothing in this Section 13 or in these Terms is intended to, and nothing shall, limit or exclude any liability that cannot lawfully be limited or excluded under the laws of the State of California, including but not limited to liability for fraud, gross negligence, willful misconduct, violations of California Civil Code § 1668, personal injury, or death caused by our acts or omissions. California residents retain all rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA) as described in our Privacy Policy.
(e) No obligation to continue. The beta designation may be removed, modified, paused, or the service may be suspended or terminated, in whole or in part, at our sole discretion at any time. We have no obligation to release, support, maintain, or migrate data into any future production version of the service.
(f) Feedback license. If you submit feedback, bug reports, or suggestions about the beta service, you grant TimeTracker.Best a non-exclusive, royalty-free, perpetual, irrevocable, worldwide license to use that feedback for any purpose, including product development. We will not publicly identify you as the source of any feedback without your consent.
(g) Backup, recovery, and security response. We take the integrity of your data seriously. Account and time-tracking data is stored on Google Cloud Firestore, which provides automatic multi-zone replication, continuous redundancy, and point-in-time recovery infrastructure as part of its standard service. In the event of a security incident, data corruption, unauthorized access, or similar disruption, we will (i) make commercially reasonable efforts to restore affected data from backups as promptly as possible, (ii) investigate the incident, and (iii) notify affected users in accordance with applicable law (including the California Consumer Privacy Act / California Privacy Rights Act where applicable). This commitment to backup and recovery does not modify, waive, or limit any of the disclaimers or limitations of liability in Section 12(a)–(f) or elsewhere in these Terms, and we cannot and do not guarantee that every data point will be recoverable in every scenario. You remain encouraged to export and retain your own copies of any data you consider important via the app's CSV / PDF export features.
(h) Severability. If any provision of this Section 12 is held invalid or unenforceable by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
If you do not accept the terms in this Section 13, do not create an account, sign in, or otherwise use the service during the beta period.
